Terms of Use
These terms apply to Kiuboid, a service for creating, hosting and publishing 360° virtual tours. They cover both this website at kiuboid.com and the application at app.kiuboid.com. By creating an account or using the service you agree to them.
Basic terms
You must be at least 16 years old to use Kiuboid. You are responsible for your account and for everything done through it, and for keeping your sign-in credentials secure. Tell us at support@kiuboid.com if you believe someone else has gained access to your account.
The service
Kiuboid lets you upload 360° panoramas, arrange them into multi-scene tours, connect them with hotspots, and publish a tour to a public viewer that visitors can open without signing in. A published tour can be shared as a link, embedded in another page, or opened from a QR code. A workspace can have several members, each with an Owner or Editor role.
We add and change features over time. We may also change or discontinue parts of the service; where a change would materially reduce what a paid plan provides, we will say so before it takes effect.
Plans, payments and subscriptions
Our order process is conducted by our online reseller Lemon Squeezy. Lemon Squeezy is the merchant of record for all our orders. Lemon Squeezy handles all payments, and is the name that will appear on your card or bank statement.
Paid plans are charged in advance, in US dollars, on the day you subscribe, and cover the month or the year you selected. Subscriptions renew automatically at the end of each period until you cancel. You can change plan or cancel at any time from the billing screen in the app or from the Lemon Squeezy customer portal, which is one click away from it. Cancelling stops the next renewal; your plan continues until the period you have already paid for ends.
Taxes are handled by Lemon Squeezy as merchant of record, and any tax due is shown at checkout before you pay.
Refunds
We offer a 30-day money-back guarantee on the first payment of a subscription. The details, and how to ask for a refund, are in our Refund Policy.
Your content and your rights
You keep every intellectual property right you already have in the panoramas, tours and other material you upload. We claim no ownership of it.
So that we can actually run the service, you grant us a non-exclusive, royalty-free licence to store your content, process it as needed to display it — for example generating the thumbnails and the reduced-size images a viewer loads — and show it to the people you have published it to. That licence exists only to operate the service and ends when you delete the content or close your account.
You confirm that you own the content you upload or otherwise have the right to upload it, that publishing it does not infringe anyone else’s rights, and that you have any permission needed from people or property shown in it.
Acceptable use
What you may not do with Kiuboid is set out in our Acceptable Use Policy, which forms part of these terms.
Copyright complaints
If you believe content hosted on Kiuboid infringes your copyright, our copyright policy explains how to tell us and what we do about it.
Kiuboid is not a backup service
Keep your own copies of your original panoramas. We take backups for our own operational purposes, but the service is not a backup product and you should not rely on it as one. We are not liable for content that is lost, and we may remove content that breaches these terms.
Suspension and termination
You can close your account at any time. We may suspend or close an account that breaches these terms or the Acceptable Use Policy, or where we are required to by law.
If you move to a plan with lower limits than you are currently using, nothing you have already made is taken away: existing tours stay published and existing files stay stored. What the lower limit refuses is adding more — publishing another tour, inviting another member, or uploading more media — until you are back within it.
No warranty
Kiuboid is provided as it is. We work to keep it available and correct, but we do not warrant that it will be uninterrupted or error-free, or that it will meet a particular requirement.
Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential loss, for lost profits, or for lost data. Our total liability arising out of the service is limited to the amount you paid us in the twelve months before the claim arose.
Indemnity
You agree to cover us against claims brought by someone else that arise from content you uploaded or published, or from your use of the service in breach of these terms.
Changes to these terms
We may update these terms. If a change is material we will give notice in the app or by email before it takes effect, and the effective date at the top of this page will change.
